These benefits come with an annual 3% cost of living increase until the injured worker reaches the age of 62.  
  • Death benefits: In the unfortunate event that a work-related injury or occupational illness is fatal, workers’ compensation can ease the financial burden on the employee’s family by covering burial expenses up to $7,500, offering education benefits to the employee’s spouse, and providing the employee’s spouse and dependents with bi-weekly compensation of up to $150,000 paid in bi-weekly payments of two-thirds the employee’s average wages.

Weekly disability benefits cannot exceed the state’s average weekly wage, as determined by the Florida Department of Economic Opportunity. This maximum payment amount is adjusted annually on the first of the year. As of January 1, 2021, the weekly maximum payment is $1,011.
